Mods Nation Privacy Policy

MISTY ISLANDS LTD CO ("Mods Nation," "we," "us") operates modsnation.com and its related services. This policy explains what we collect, why, who we share it with, and what you can do about it.
1. Who this applies to
This policy covers everyone who uses Mods Nation, whether signed in or not. Some sections apply only if you use a particular feature — paid renders, the marketplace, chat, or the map.
2. Information you give us
Account. You sign in through Google. We do not create or store passwords and never see one. From Google we receive your name, email address, profile picture, and your unique Google account identifier. If we add another sign-in provider, we will update this policy before doing so.
Profile. Display name, avatar, and anything else you choose to add.
Content you publish. Build configurations, photographs, decal and logo images you upload, journal entries and episodes, articles, comments, marketplace listings, event listings, votes in polls and ratings, likes and saves.
Messages. Chat messages, direct messages, and reports you submit about other members' content.
Business applications. If you apply as a shop, retailer, or manufacturer, the business details you submit, including company name, address, and business email.
Payments. If you subscribe, Stripe collects your payment details. We receive from Stripe only your subscription status, plan, and payment history — never your card number.
3. Information we collect automatically
Technical. IP address, browser and device type, operating system, screen resolution, and referring page.
Usage. Pages viewed, features used, interactions with the 3D configurator, renders generated, searches, and clicks. We keep our own event counters and a sample of raw events for product analytics.
Presence and activity. If you are signed in, we record when you were last active and, where you have these features switched on, what area of the platform you are in and what radio station you are listening to. This appears next to your name in chat and in member lists, so other members can see it. You can switch activity and radio visibility off in account settings; your account keeps working with them off.
Approximate location. We derive an approximate location from your IP address — at the level of a region or city, not a precise position — to sort nearby shops and events, to choose radio stations, and to place builds on the map. You can control what is shown on the map in account settings.
Precise location. Some marketplace features ask your browser for your device location to show how far a listing is from you. Your browser asks you first, and you can refuse or revoke that permission at any time in your browser. We do not collect precise location anywhere else.
Cookies. See Section 8.
4. How we use it
- To run your account and show you your content.
- To display what you publish to other members, as you chose to publish it.
- To operate paid features and process your subscription.
- To keep the platform safe: detect fraud, abuse, spam, ban evasion, and automated scraping.
- To moderate content, including automated filtering of messages before they are published.
- To measure how features are used and to improve them.
- To respond to your support requests.
- To send you email you have asked for, and service email you cannot opt out of, such as security notices, billing confirmations, and changes to these terms.
- To comply with law and to enforce our agreements.
5. Paid renders and AI processing
When you generate a photoreal render, we send the render request to a third-party AI image generation provider. That request includes the scene description, images of the 3D model as configured, and any image you supply as an input — for example a photograph or a logo.
We do not send your name, email address, or account identity to that provider. Processing takes place in the United States.
We store the renders you generate, the inputs you supplied, and the record of MODS spent.
6. Marketplace, auctions, and shops
Listings. What you put in a listing is public, including photographs and any contact preference you choose to show. Do not put your home address or personal phone number in listing text; if you do, it is public because you made it so.
Seller outreach. Some vehicle listings on the platform originate from publicly available sources rather than from a member. Where we can identify a likely owner from those sources, we may contact them once by email to tell them the listing exists and offer to hand it over. Every such message includes a way to opt out, and we do not store contact details found this way beyond what is needed to send and honor that opt-out.
Auction data. We display and analyze data from public vehicle auction sources, including Copart. Bidding does not take place on Mods Nation. This data concerns vehicles, not you, and we do not match it to your account.
Shops. Shop directory entries are built from public business information. If you claim a shop, the business details you submit become part of that public entry.
7. Messages, moderation, and reports
Direct messages are not end-to-end encrypted. We can access message content where needed to operate the service, to respond to a report, or to comply with law.
Messages pass through automated filtering before publication. Blocked messages and filter triggers are logged.
If you report content, we keep the report, including which account submitted it. We do not show your identity to the member you reported. If your content is reported or removed, we keep a record of the decision.
8. Cookies and similar technologies
Strictly necessary. Authentication and session cookies (access-token, UID, publicKey), security, and load handling. These cannot be turned off.
Functional. Your preferences — theme, display settings, saved configurator state.
Analytics. Google Analytics and our own event collection, used to understand feature usage.
Embedded video. Part of the ModsTV library is curated shows and episodes hosted on YouTube. When you play one, Google sets its own cookies, including for its own measurement. We do not receive that data.
Where consent is required, these non-essential cookies — analytics and embedded video — are not set until you give it, and you can change or withdraw your choice at any time on our Cookie Settings page. We honor the Global Privacy Control signal where your browser sends one.
9. Who we share it with
We do not sell your personal information, and we do not use your activity to target advertising to you. What we show you is contextual: open a BMW build and you will see content related to that build. It follows from what you are looking at, not from a profile built about you.
Other members. Everything you publish, plus your display name, avatar, and presence.
Service providers. Hosting, storage and content delivery, authentication, payment processing, email delivery, real-time messaging, analytics, and AI image generation. They act on our instructions and may use the data only for what we ask.
Manufacturers and brands. Aggregated, statistical information about how their products appear in builds and configurations — counts and regional distribution, never individual identity. Manufacturers do not receive your email, your name, your private builds, your messages, or the identity of anyone who expressed interest in a product.
Law and safety. Where required by law or legal process, or where we believe disclosure is necessary to protect our rights, the platform, or someone's safety.
Business transfer. If we are acquired or merge, your information may transfer as part of that transaction.
10. How long we keep it
We keep personal data no longer than we need it for the purpose it was collected for. In practice that means:
- Account data and the content you published: while your account exists, unless you delete it. Deleted items may persist in backups until those backups age out.
- Messages: while your account exists. Records of content we removed, and of the reasons, are kept as long as we need them to enforce our rules against repeat violations.
- Payment records: for as long as tax, accounting, and chargeback rules require.
- Server and security logs, including IP addresses: for as long as they are useful for detecting and investigating abuse and security incidents.
- Analytics: raw events for as long as needed for product analysis; aggregated counters, which do not identify you, indefinitely.
- After you delete your account: personal data is removed within 30 days, except where we must keep it by law, for fraud prevention, or in relation to an unresolved dispute or chargeback.
- Record of your acceptance of our terms — the date, the version you accepted, and the IP address it came from — is kept after your account is deleted, for as long as a claim about that agreement could still be brought. This is the evidence that the agreement between us exists, and it is kept in minimized form, without your name, email, or content.
11. Your choices
Everyone.
- See and edit your profile in account settings.
- Control what other members see about you — map visibility, activity, and radio — in account settings.
- Delete individual content while your account is active.
- Delete your account from account settings. Cancel any subscription first; deleting an account does not itself cancel billing.
- Request a copy of your data by writing to support@modsnation.com.
- Manage cookies at Cookie Settings.
- Unsubscribe from marketing email using the link in any such email. Service email continues.
EEA and UK. You have the rights to access, correct, delete, restrict, object, and port your data, and to withdraw consent. We rely on: consent (analytics where required, marketing email), performance of a contract (running your account and paid features), and legitimate interests (security, abuse prevention, product improvement). You may complain to your national data protection authority.
California. You may request to know what we collected, request deletion, request correction, and you will not be treated differently for asking. We do not sell personal information and do not share it for cross-context behavioral advertising.
To exercise any of these, write to support@modsnation.com. We verify identity before acting and respond within the time the applicable law allows.
12. Children
Mods Nation is not for anyone under 16. We do not knowingly collect data from a child under 16, and we delete such accounts when we learn of them. If you believe a child under 16 has an account, write to support@modsnation.com.
13. Security
Sign-in is delegated to your identity provider; we never hold a password. Data in transit is encrypted with TLS. Access to personal data inside the company is limited to those who need it. No system is perfectly secure, and we cannot guarantee absolute security. To report a vulnerability, see /.well-known/security.txt.
14. International transfers
We operate from the United States. If you use Mods Nation from elsewhere, your data is transferred to and processed in the United States and in the countries where our service providers operate. For transfers out of the EEA and UK we rely on the European Commission's standard contractual clauses with our providers, and on your consent where applicable.
15. Third-party services
YouTube. Video features use YouTube's embedded player and the YouTube API Services. Your use of them is subject to the YouTube Terms of Service and the Google Privacy Policy. You can revoke our API access at Google security settings.
Radio. Station streams are provided by third parties and play directly from their servers. We do not host or rebroadcast them. What you listen to may be shown to other members as presence information.
Links and affiliates. Links to retailers and manufacturers leave our platform; their privacy practices are their own. We may earn a commission on qualifying purchases, which does not change the price you pay.
16. Changes
We will update this page when our practices change, and will notify you by email or a notice on the platform for material changes. The effective date is at the top.
